Personal Injury Frequently Asked Questions

  • Does New Hampshire have a statute of limitations on personal injury claims?

    Yes. Under RSA 508:4, most personal injury lawsuits in New Hampshire must be filed within three years of the injury. Miss that window and the court will almost certainly dismiss your claim, no matter how strong it was.


    Three years sounds like plenty. It isn't. Medical treatment has to run its course before anyone knows what the claim is worth, and insurers are in no hurry. Certain claims,  particularly those against a government entity, carry much shorter notice requirements that can expire in a matter of months.


    The practical takeaway: an early conversation costs you nothing and preserves options that quietly disappear over time.

  • How does fault work in New Hampshire?

    New Hampshire follows modified comparative fault under RSA 507:7-d. You can still recover if you were partly responsible. Your award is just reduced by your share of the blame. But if your fault is found to be greater than the other party's, you recover nothing at all.


    That threshold is why insurers work so hard to assign you a percentage. Moving you from 45% to 55% doesn't trim their exposure; it eliminates it. Early documentation, and care about what you say to an adjuster in the first days, matter enormously as a result.

  • What happens if I was injured by somebody with no insurance?

    New Hampshire is the only state that doesn't require drivers to carry auto insurance. Drivers must instead satisfy the state's Financial Responsibility Law, and roughly one in ten NH drivers carries no coverage at all.


    If you're hit by one of them, your own uninsured/underinsured motorist coverage may be the only meaningful source of recovery. New Hampshire policies also include MedPay, which covers accident-related medical bills regardless of fault.
