Henniker is our nearest neighbor — a fifteen-minute drive west on Route 202. It's also the most legally distinctive town in this part of Merrimack County, because it's two things at once.
It's a college town, home to New England College, with a rental market shaped by a student population and a median age of 33. And it's a resort town, with Pats Peak, the Contoocook River, and a steady flow of seasonal visitors. Both of those produce legal questions that don't come up in Bow or Warner, and the answers aren't always the ones people expect.
The Rental Rule Most Henniker Landlords Get Wrong
If you rent property in Henniker, this one matters.
New Hampshire's security deposit law, RSA 540-A, doesn't apply to every rental. It excludes someone who rents a single-family residence and owns no other rental property, and someone renting units in an owner-occupied building of five units or fewer. A lot of Henniker landlords fall into those categories and are outside the statute.
But two wrinkles catch people:
The exemption disappears for tenants 60 and older. A landlord living in a four-unit building is outside the law — until one tenant turns 60, at which point that unit falls squarely inside it.
The statute excludes vacation and recreational rentals. Which means a Henniker owner who rents to students during the school year and to skiers over the winter may be operating under two different sets of rules with the same property.
Getting this wrong is expensive: failing to return a deposit properly exposes a landlord to double the deposit amount. Getting it right is mostly a matter of knowing which category you're in before the lease is signed.
